Agreement to Our Legal Terms
SARL DAAB is a company registered in Algeria, located at 10 Rue des Frères OUDEK, El-Harrach 16200, Algiers, established on August 18, 2024.
SARL DAAB owns and operates MAJOR, an educational Software-as-a-Service (SaaS) platform designed for private schools, teachers, tutors, students, and their parents or legal guardians.
By accessing or using MAJOR, you confirm that you have read, understood, and agreed to be bound by these Terms of Service. If you do not agree, you must discontinue use immediately.
1. Our Services
The Services are intended primarily for use in Algeria. Access from jurisdictions where the Services are illegal is at your own risk.
MAJOR provides technical and administrative digital tools, including class and group management, student enrollment tracking, communication tools, and attendance, scheduling, and notification features.
MAJOR does not provide educational content and does not act as a school, teacher, tutor, or educational authority. All educational decisions, supervision, grading, and disciplinary actions remain the sole responsibility of the school or teacher.
2. Intellectual Property Rights
All intellectual property rights related to the Services are owned by or licensed to SARL DAAB. Subject to compliance with these Terms, you are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal or internal business purposes only. Unauthorized use is strictly prohibited.
3. User Representations
By using the Services, you represent that:
- Information you provide is accurate and current
- You have legal capacity to enter into these Terms
- If you are a minor, you are supervised by a parent or legal guardian
- You will not use the Services unlawfully
- Your use complies with applicable laws
Violation may result in suspension or termination.
4. User Registration
Registration is required. You are responsible for safeguarding account credentials and all activity under your account. We may modify or remove usernames that are misleading, inappropriate, or infringe rights.
5. Purchases and Payments
General: MAJOR is not a payment processor and never stores payment card or banking data.
School Responsibility: Schools manage payments with parents and students. Pricing to parents is determined solely by schools. Pricing suggestions by MAJOR are non-binding.
Payments Between Schools and MAJOR: Handled directly between schools and SARL DAAB, paid in cash or via authorized third-party providers. MAJOR does not process parent payments.
No Liability: MAJOR is not responsible for payment disputes, late or unpaid fees, or refunds between schools and parents or students.
6. Software Availability
The Services may include updates, changes, or bug fixes. No uptime guarantee or Service Level Agreement (SLA) is provided unless explicitly agreed in writing.
7. Prohibited Activities
You agree not to misuse the platform, attempt unauthorized access, upload harmful or unlawful content, reverse-engineer the software, or use MAJOR to compete with SARL DAAB. Violations may result in immediate suspension or termination.
8. User-Generated Contributions
Users may submit content. You remain solely responsible for your content and confirm it is lawful and non-infringing.
9. Contribution License
By submitting content, you grant SARL DAAB a worldwide, royalty-free license to use and display it solely for operating the Services. You retain ownership of your content.
10. Reviews
Reviews must be honest and lawful. We may remove reviews at our discretion.
11. Mobile Application License
You are granted a limited license to install and use the MAJOR app on devices you own or control, subject to these Terms and app store rules.
12. Third-Party Services
We are not responsible for third-party websites, services, or policies.
13. Services Management
We may monitor usage, remove content, suspend or terminate accounts, and protect system integrity.
14. Privacy Policy
Your use of the Services is subject to our Privacy Policy. Data may be hosted in Algeria and processed outside Algeria where necessary under appropriate safeguards.
15. Term and Termination
These Terms remain effective while you use the Services. We may suspend or terminate access for violations, security or legal reasons, or operational needs. Upon termination, access may be disabled, and certain data may be retained as required by law.
16. Modifications and Interruptions
We may modify, suspend, or discontinue the Services at any time. We are not liable for interruptions or unavailability.
17. Governing Law
These Terms are governed by the laws of Algeria. Algerian courts have exclusive jurisdiction unless arbitration applies.
18. Dispute Resolution
Parties agree to attempt informal resolution first. If unresolved, disputes may be submitted to arbitration seated in Algiers, conducted in French or Arabic, under Algerian law.
19. Corrections
We may correct errors or inaccuracies at any time without notice.
20. Disclaimer
The Services are provided "as is" and "as available" without warranties of any kind.
21. Limitation of Liability
To the maximum extent permitted by law, SARL DAAB shall not be liable for loss of data, loss of profits or revenue, business interruption, or indirect or consequential damages. Total liability shall not exceed the amount paid to SARL DAAB in the twelve (12) months preceding the claim.
22. Indemnification
You agree to indemnify SARL DAAB against claims arising from your misuse of the Services, your content, or your violation of these Terms.
23. User Data
You are responsible for the data you provide. We perform reasonable backups but do not guarantee data recovery.
24. Electronic Communications
You consent to receive electronic communications and accept electronic records and signatures.
25. Miscellaneous
These Terms constitute the entire agreement. If any provision is invalid, the remaining provisions remain effective.
